Liability Waiver, Assumption of Risk & Release

This Liability Waiver, Assumption of Risk and Release ("Waiver") is entered into by you ("Participant") in favor of the venue, its owners, operators, officers, employees, coaches, contractors, and affiliates (collectively, the "Released Parties") in connection with your use of the venue's courts, facilities, equipment, programs, open play sessions, coaching sessions, tournaments, and events (collectively, the "Activities").

This Waiver is governed by the laws of the Republic of the Philippines, including the Civil Code of the Philippines and applicable consumer-protection statutes. Please read it carefully before using the venue.

1. Voluntary Participation

I confirm that I am participating in the Activities voluntarily and of my own free will. I am at least 18 years of age, or if I am a minor, my parent or legal guardian has reviewed and signed this Waiver on my behalf and acknowledges the risks set out below.

2. Acknowledgment and Assumption of Risk

I understand that racquet and court sports involve inherent risks of physical injury and property damage, including but not limited to:

• Slips, trips, and falls on the playing surface, including injuries from sudden direction changes, lunges, and dives
• Strains, sprains, fractures, dislocations, contusions, and other musculoskeletal injuries
• Impact injuries from balls, paddles, racquets, nets, posts, court walls, fencing, and other equipment
• Collisions with other players, coaches, or bystanders
• Heat-related illness, dehydration, fatigue, fainting, and cardiovascular events
• Pre-existing or undisclosed medical conditions that may be aggravated by physical activity
• Eye injuries (eye protection is recommended and is the participant's responsibility)
• Loss, theft, or damage to personal property left at the venue

I expressly assume all such risks, whether known or unknown, foreseeable or unforeseeable, that arise out of or relate to my participation in the Activities.

3. Medical Fitness and Self-Assessment

• I represent that I am physically fit and have no medical condition that would prevent me from safely participating in the Activities. I have consulted a physician where appropriate.
• I understand that the Released Parties are not medical professionals and do not pre-screen participants. It is my responsibility to know my own physical limits and stop play immediately if I feel unwell, dizzy, short of breath, or in pain.
• I authorize the venue to call for emergency medical assistance on my behalf if I am unable to do so. I agree to be responsible for any cost of emergency medical evaluation, transport, or treatment arising from my participation.

4. Release and Waiver of Claims

To the fullest extent permitted by Philippine law, I release, waive, discharge, and covenant not to sue the Released Parties from any and all liability, claims, demands, actions, and causes of action arising out of or related to any loss, damage, or injury (including death) sustained by me in connection with my use of the venue or participation in the Activities, except where such loss, damage, or injury is caused by the gross negligence or willful misconduct of the Released Parties.

5. Indemnification

I agree to indemnify, defend, and hold harmless the Released Parties from any third-party claims, judgments, losses, costs, and expenses (including reasonable attorney's fees) arising out of my own negligence, breach of this Waiver, or violation of venue rules.

6. Compliance with House Rules and Staff Instructions

• I agree to follow the venue's published House Rules at all times, including footwear, behavior, equipment, and queue requirements.
• I agree to follow staff instructions regarding court use, time slots, safety procedures, and emergency response.
• I understand that the venue may suspend my booking privileges or refuse entry for repeated rule violations or unsafe conduct.

7. Use of Venue Equipment

If I use paddles, racquets, balls, ball machines, or any other equipment provided or rented by the venue, I agree to use it only for its intended purpose, to inspect it before use, and to report any defect immediately. I am responsible for damage caused by my misuse or negligent handling of venue equipment.

8. Photo, Video, and Likeness Consent

I understand that the venue may, from time to time, capture photos and video at the facility for safety, security, operational, and promotional purposes. Unless I have submitted a written objection to the venue, I grant the venue a non-exclusive, royalty-free license to use my image and likeness in venue communications and marketing materials. I may withdraw this consent at any time prospectively by written notice.

9. Personal Property

I acknowledge that the venue is not responsible for loss, theft, or damage to personal property (including phones, wallets, keys, paddles, racquets, bags, and clothing) brought onto or left at the venue. I am solely responsible for safeguarding my belongings.

10. Communicable Disease Acknowledgment

I understand that physical activity in shared indoor or outdoor environments carries an inherent risk of exposure to communicable illnesses. I agree not to use the venue if I am currently experiencing symptoms of a transmissible illness, and I assume all risk of such exposure that may occur during my participation.

11. Minors

If the Participant is under 18 years of age, the Participant's parent or legal guardian must read and sign this Waiver. By signing on behalf of a minor, the parent or guardian represents that they have authority to bind the minor and accepts all of the assumptions, releases, and indemnities in this Waiver in the minor's place.

12. Severability

If any provision of this Waiver is held to be invalid or unenforceable under Philippine law, the remaining provisions shall continue in full force and effect, and the invalid provision shall be replaced with a valid provision that most closely approximates the original intent.

13. Governing Law and Venue

This Waiver is governed by and construed in accordance with the laws of the Republic of the Philippines. Any dispute arising out of or relating to this Waiver shall be resolved first through good-faith negotiation. If unresolved, the parties submit to the exclusive jurisdiction of the courts in the locality where the venue operates.

14. Acknowledgment

I have read this Waiver in full. I understand that by booking, checking in, or otherwise participating in the Activities, I am giving up substantial legal rights, including the right to sue the Released Parties for ordinary negligence. I sign this Waiver voluntarily and without inducement.

By using the venue or any of its services, I agree to be bound by this Liability Waiver, Assumption of Risk and Release.
